File a formal complaint with SigPhoto, and report abuse to their ISP

My ORIGINAL shot without the Photoshopped cheesy background.... and
the EXIF is intact..... not a Nikon shot

What should I do about it? I have already complained to Photosig
and want his (paid) account DELETED. Should I go further?

Gotta love the internet.... if you can't create it.... STEAL IT !!!!

There are lots of photos that will look great on my website, and you were kind enough not to put the copyright on the actual image - that will save me lots of time.

Just kidding, but this kind of theft happens all the time, and there's not much you can do unless the image is used commercially and you can prove that yours came first.

do you shoot for Nat'l Geographic?

Presenting another persons work as your own is indeed wrong. Presenting yourself as something you're not, is also wrong.

If you do shoot for NG....thanks! That's a job I would kill (but not copy) for.

starters....what is the image worth? Could it have been sold multiple times for $000s of $?.....PUBLISHED WITHOUT COPYRIGHT claim makes it public domain....

Calendar company comes out with it (if it was high enough res to publish) and what you going to do sue? They will claim quite correctly that they got it off the internet and that there was NO claimed copyright...or that they got the permission from the claimant to copyright...the guy who posted it did claim copyright.....so you going to sue him and make lots? He will got bankrupt the day after you win in court,and you will be out $10,000 in legal fees, and get no compensation, and the calendar company will walk......At the most you would get "fair market" for use of the image, which would probably be less than $2000 in that type of usage....

and people on this site wonder why pros want to sign all their work......
unless he is selling it there is likley no legal action that can be
viably take against him/her. What damages have actually occured?

The Cp5700(Nikon), is actually quite good. I used to own it, and it made some excellent pictures, providing you keep it only up to ISO 200. Above that, it will produce some horrible noise.

I just can't understand why anyone would/could do such a thing. Am not that good a photographer, but still value my own work. Obviously, he doesn't.
This might just be some poor 15 year old looking for attention from
some hot little babe, but it makes me sick. I want to send a
police car over to his house, rap on his mom's front door with a
night stick, and say, "Knock it off, or you're going to lose your
camera, your computer, and you'll be sitting in court, trying to
come up with an excuse for your behavior."

What size photo would you consider safe enough for putting on the web?
I usually go up to 600x400pix and a size of about 50-60kb.
Yep. I've found my photos on a Russian website once, and once on a
Dutch website as well. Not much you can do about it, especially
since the Dutch idiot didn't even bother to remove my Copyright
notice from the photos! (shakes head) grin

It's my main reason for not posting large, good quality images on
my website. Unfortunately, surfers will have to put up with
high-compression JPEGs from me for the time being... :-(

It's so obviously plaigerized and butchered, no one who acknowledges that Elvis is dead could possibly think his shot is real. He's taken an excellent image and turned it into something bizarre, with impossible lighting that reminds me of the flying scenes in The Wizard of Oz.

That sounds about right. Most of my web photos are 550 pixels on the long side, and compressed as much as I feel comfortable doing. it's all you can do to prevent theft (hey, if they want the low-res photos, good luck to them! :-)).

I'm dying to know who it is. I'm nosey. I hope he gets the boot
and publicly should apoligize to you here.
The official word from Photosig is.... they have warned him, and
will be watching him. Since he deleted the post before they saw it
there is nothing more than that, that they can do. I did sent them
his picture and mine in an E-mail so they could compare them. They
acknowledged that he did indeed rip off my shot. I have bookmarked
his portfolio, and will be checking from time to time for ANYTHING
that looks suspicious. Chances are... he will just go away.

Presenting yourself as something you're not, is also wrong.

The lighting is 'all wrong', lol. The sun is in the sky, behind
the clouds, behind the bird.. yet, magically, the 'shooter' managed
to, oh I dunno, used an 80/20 lumiquest and bounced some flash off
the clouds directly overhead to light the top of the bird that way
and filling in the facing side for good measure.

Another fine example of "crime and stupidity" being a poor mix.

I'm not sure it's public domain just because it's published without copyright notice. If some guy at your local photo lab liked your pic and published it on web without your knowledge it woudl be public domain, by your definition.

Copyright is established at time picture is made. Copyright notice and regristration of image with PTO (U.S. Patent & Trademark Office) only make it easier to file legal claims and collect more damages.

Copying and hacking photos witout authorization is illegal, as far as I know, without regard to re-sale or copyright notice and regristration.

Just because it's easy to violate copyright law and difficult to enforce it doesn't make it legal and doesn't mean that a photographer gives up his rights to his images just by publishing them on a web site.

"Answer" or not.....I have absolutely no doubt that the intent here was to pose as a nat'l geographic photographer. You wear a baseball cap while shooting pictures, ergonomics dictate that you turn it around. You don't turn it square to another camera that is taking a picture of you...unless the thing you REALLY want to emphasize is the logo on the cap. If I was a REAL Nat'l Geographic reporter, this would pissmeoff. Kindof like the schmoes who wear Navy Seal t-shirts that have never even seen the ocean.

I just can't take this guy's complaint seriously, when he's so patently guilty of essentially the same ethical transgression that he waxes wounded about.

Pretense is pathetic....whether it's stealing photographs, or posing.

He shoots wildlife and is a fan of National Geographic. THAT is what I take from the photo.

I have a San Francisco Giants hat (ok...several) and guess what....I don't play for the team. Oh and guess what else (this will blow your mind)...I have a photo of myself in said hat at the ballpark! The nerve of me!
