Big problem with selling my RX100IV on Ebay (item swapped)

Hi, I have had a very unfortunate issue selling my RX100IV on Ebay in UK.

Not sure if anyone else had had anything similar happen and can offer any advice?

I sold the camera with a few accessories for £365, so i was due to receive £318
I posted it next day delivery and insured it for the price it sold for (probably a bit naive, i should have really insured it for the total value of the camera).

The delivery was scheduled with Evri via Packlink through the Ebay site .

The day that it should have been delivered, there was no update on the tracking, i left things this day thinking maybe they are just really busy etc.

The day after there was still no update, so i tried to contact Evri, but they seem to make it extremely difficult to speak to a human, i ended up having to go through packlink to speak to someone and even then, it was only via live chat.

I was told they would contact Evri and try and chase it up for me, i then got an email the next day saying the parcel is in the network and will be delivered within 72 hours. The tracking had then updated to on way to buyer’s local hub.

I let the buyer know about what had been said and it turns out he received it yesterday morning.

He then sent me a message on ebay saying I have sent him a playstation game, and seem to have made a mistake.
He then sent me some pictures after i said i have definitely not sent you a ps game.

The picture was the parcel bag i used with the label i printed in the drop off store, all the bubble wrap i used had been reused to wrap around this game, you could clearly see in the picture it was still sealed were you close it, but a slit had been made lower down and brown parcel tape had been used to cover this up, so does look like it's been swapped by someone.

The buyer has now requested a full refund, which obviously i would have to honour, i created my own incident with Ebay, but their response seems just be we can't prove anything so i will have to take it up with the currier, which i intend to now do (ebay had said don't yesterday stating they will investigate it all). but have emailed me today suggesting i not do file a claim with evri or packlink.

Has anything like this ever happened to anyone?

I have a feeling the currier company will also just try and say, well they can't prove i didn't just post a game, and they have the parcel tracking stating the item has been delivered successfully so that’s it.

I obviously don't have any other way of proving my case apart from showing the ebay invoice and details and the fact the tracking was linked to that sale, but that doesn't prove that’s what i sent does it?

I obviously would have been happy with the money i was going to make from the sale, but because of what’s happened, should i be pushing for compensation in regards to the full value of the items? or would i only be covered to the insurance i paid for?

Can anyone offer any advice at all?

Someone has essentially stolen your gear using a scam that leaves you with no effective recourse. Sadly, I don't think you have a chance for any kind of recovery.

A bit of a silver lining, though: You should get possession of the PlayStation if you want to pay the return postage (and if you want to trust your delivery service).

This could, of course, have nothing to do with the courier and this, the wrong goods scam, could simply be a modification of the empty box scam (purchaser claims only box arrived) or the broken replica scam (purchaser claims goods broken and produces pic of a replica which is broken). Perhaps further discussions with Ebay about your purchaser's record are warranted? At least you have insurance.

Thanks for the reply, it was only a ps2 game that he received, so paying for the delivery to get it returned would be pointless as i really wouldn't make much at all on it.

Theres no way to even avoid this type of scam is there as there was no indication at all that anything was suspicious, the buyer has got a few hundred feedback with 100% positivity.

So i really dont know if it's him or someone who works at Evri.

I have just found out that Cameras are on Evri's exclusion list for insurance as well.
 
An unfortunate situation.

I once sold a camera on eBay here in the US, and left the package with my shipping department in my company, to be shipped via UPS.

When the buyer received and opened the package, he reported there was nothing. but a few stones in the box.

I never knew if someone in my company stole the camera and replaced with the rocks, or if someone in the UPS system did so, or even for that matter if the buyer was dishonest about what he received.

In any event, I would up giving the buyer a full refund to preserve my eBay rating.

It's one of the risks inherent not just in eBay transactions, but also in shipping parcels as the seller.

Since then (knock on wood) it has not happened since after many more eBay sales.
 
I was scammed out of $1300 by someone in Ireland. Camera apparently didn't exist. He/she kept putting me off by sending me notices that the tracking number would be sent after the weekend after I asked for it. Money gone, no camera sent. Complained to EBAY. They said wait - so I waited the required time. Then they said to check with my credit card company - did that and waited some more - then EBAY said they would not refund anything because I'd contacted my credit card company. ????? The card company initially refunded the amount to my card. About a month later they took that amount back as they could not find the scammer. ?????

Bottom line - I'm out $1300. Ebay read themselves out of any refunds by telling me to contact my card company, and later the card company took back what they initially refunded because they could not find the scammer. What a run around, but I'm still out the money

Bottom line 2 - Buyer beware - and in your case, seller beware. Note _ I've had other good buys on Ebay. but I stopped for a looooong time.

Evri - new name for Hermes, same crap service. I had a delivery disappear earlier this year, about the time the name changed. The seller refunded me as the item was now out-of-stock. About three months later it turned up!
