A few days ago I posted my sad story of getting caught for trespassing while trying to get a shot for Challenge 17.

Here's the best of the two images I was able to shoot before I got nabbed. The picture has no redeeming qualities: uninteresting subject, tilted horizon, no scenery, etc. Just posting it here for grins. Note where the road is: about 20 feet from where I was standing.

I can't believe you got a ticket for that!! What if you had been standing on the road, would you have gotten a ticket for that? Cars cross there, bikes, pedestrians...

Ditto? I was thinking you were in some area with a load of tracks that you had to go thru a fence to reach. From the image you display and the proximity to the road, that ticket seems extremely unfair.

Was someone recently killed by a train in the area. Thus they are patrolling or enforcing it more to 'get the word out' ?

Anyway bring the picture. Hmmm. To our legal readers, would that be evidence to support the defendent or convict him?

standing on the road, would you have gotten a ticket for that?

That's exactly where I was "busted." No one was recently killed there, as far as I know. The cop was there (across the street, just to the right of the frame) waiting for the scheduled crossing of the train. A minute or so after the cop wrote the ticket, the gates came down, the alarms went off, and the train came through. I guess the cop was there to protect people from the train.

As I mentioned in an earlier post, the cop was doing his job, so I hold nothing against him. I also have some help from friends who are getting me through this from a legal perspective, and since I've never been in trouble before, I'll be fine.

Notice it's light is still on. It was still moving (albeit backwards)!! I could see getting a ticket for going into the trainyards though. 9-11 has made folks more paranoid.

I would take it to court - any judge in his right mind will dismiss that.

You gave away some of the mystery of the shot! Now I know the train was moving AWAY from you instead of coming toward you! Nonetheless, it's a great shot.

So your train was still moving. I doubt that anyone got quite as close as I did (and got away with it!)

May explain why police were checking out people playing near railroad just before a train arrives ... expecially with something cool looking like a DA.

If you were a REAL photographer you'd go back and get the shot right :)

I doubt the terror alert had anything to do with it. I was in a small town in upstate New York, where the nearest thing to terrorism is the over-development of land with McMansions.

Thanks for the comment on the picture. Normally I shoot a whole bunch of a particular scene from different angles and camera settings. Unfortunately I only got two shots!

...you just had a really good zoom lens is all. Admit it - you took a picture of a train in Kentucky and was standing in Missouri!!
