Skitch, I'll look forward to seeing the photos of the trouble your having. Not that I'll be of much help, digital photography is very new to me. I will watch and read with interest and truly do hope you get your problems resolved without having to go to court.

I think if you let Fuji know how upset you are with what has taken place you will see some results from them. The last thing any company wants to do is spend time in court. My advice would be... talk to them and relay your problems and do it as calmly as possible (even if you want to just YELL at them) :) I would hope Fuji would make things right for you.

Actually, bashers in the stock world are indeed paid. They get paid
to visit stock forum web sites and try to alter others opinions of
a stock, either good or bad, so that others can profit from the
reaction.

I am not a basher... and I certainly don't get paid. In fact stock
bashers have cost me money. Probably why I reacted so strongly to
the bad reviews.

Ihave bad feelings about what happens to me and my camera. I don't
want to reflect this to you.

I didn't think to show pictures of the camera...... I will do it
tomorrow.
But the result is : th more sunshine the less you see. I also can
post you some blueish black frames. You will not see the
difference.


But you can take me on my words. You even may go to court against
me.... I'm "only" describing my "FUJI" experience. Whatever you
think about me, wathever I thnk about you.....

BUT : Fot this moment I (ME) am the one who has been FUCKED by
Fuji. To be very polite.........

OK Skitch,

This and only this, is what you do if you want to have a working camera back in your hands in reasonable time.

As you know, because you accepted the retailer's "advice" and sent your camera back direct to Fuji rather than send it back to the retailer, your rights under UK law have been restricted BUT, by relying on the goodwill of the retailer and their possible (probable) lack of knowledge of the law, you MAY get the result you want.

FIRST. In the next 24 hours take the following photos in ISO100,200 and 400 using automatic white balance:

Outdoors, 1 shot each of the same subject using aperture or shutter priority.

Using the same subject also take a shot in auto mode.

Then take the same shots using cloudy white balance and do the same again using clear sky white balance. If my math is right you have 13 shots.

Then go indoors and, using whatever white balance is appropriate, take two shots of the same subject one using the built in flash, the other with your external flash.

KEEP A NOTE OF WHICH SHOT IS WHICH AND ALSO NOTE THE SHUTTER SPEED AND APERTURE SETTINGS.

If you still have a problem:

Print two copies of each on 6 inch x 4 inch glossy photopaper and save the shots on a new CD.

You now have your evidence. On Monday phone the retailer and ask to speak to a Director. Don't get into a discussion with anyone other than a Director as that wastes your time and phone costs. When you are happy you are speaking with a Director, tell them the problem precisely and concisely quoting the settings which do not work. Tell them you have asked for help on Dpreview Fuji Talk Forum without success.

Tell them (DON'T ASK) that you are sending the camera back to them at their expense for an immediate replacement.

If they accept, agree a method of sending the camera back, agree a time limit for the replacement and WRITE DOWN the name of the person you spoke to, the date, time of call in your time and UK time.

If they will not agree, tell them failure to replace the camera will result in action in the Small Claims Court and you are willing to travel to the UK to contest the action and remind them that, should you win, they will be liable not only for replacing the camera but also your costs in taking the action.

If they still do not agree, terminate the call by saying that you will be writing to them.

MAKE A NOTE OF THE COST OF THE CALL AND ALL YOUR EXPENSES.

Sit down and write a polite but forceful letter outlining the complaint, enclosing copies of the photos and stating that unless they agree to replace the camera and cover all the costs involved in the complaint within 7 days from the date of the letter, you will take an action against them in their local County Court (Small Claims Section). Remind them that you asked for help with correcting the fault through this forum and tell them you are copyingin Fuji UK.

Address the letter to the person with whom you spoke. At the same time send a copy to the Managing Director, Fuji UK, enclosing copies of the photos.

Post the letters by the fastest means, recorded delivery.

Skitch, if you do this you stand a reasonable chance of some fast action.

Post the result of Monday's call here along with the town where the retailer is based (needed because you need to know which Court to apply to for the Small Claims Action forms). I'll help as much as I can but I'm away in the Caribbean from January 8th for 18 days.

I assume you used a credit card to buy the camera.

In the UK, if you buy an item over £100 using a credit card, the card company is held to be a party to the contract.

Should the supplier take your money and fail to deliver, or fail to rectify faulty items during the first 12 months, you can claim back the cost of the item from the credit card company whose card you used.

I suggest you check your rights either with the Belgian equivalent of Citizen's Advice Bureau or by speaking to a senior manager (not a call centre manager or supervisor) at your credit card company.

World class advice there Skitch. Now you're feeling very very angry at the moment and that's undesrtandable, but don't blow up when you talk to these guys. You've got to remain calm, patient, reasonable authoratative, powerfull sounding OK. That way they'll take you more seriously. If you lose your temper with them you'll feel better but you won't get the result you're looking for. Icy cool is the order of the day.

Very nice night shots :-), don't loose your head.

It seems that metering is definately broken on your cam. They have to exchange it for a working one. You just have to find a right way to make them do it in a timely manner. I think Phil's advice is the exact thing you have to do, it is an advice that is general and works every time when dealing with bureucracy/bad service.

I've been following your tales of woe and truly empathize with you.

One always would like to feel they are in somewhat controll in a situation like this (which I know you DEFINITELY do not, thus the frustration), but to repeat some of the other suggestions and add another:
1. check out recourse with credit card company
2. try to get a hold of the highest person you possibly can within Fuji

3. try to get to the person or persons who were actually responsible for the supposed repair of your camera and ok'd it as repaired. Then go to their supervisor.

5. Send a registered letter, return receipt requested, stating your problem and solution, which you absolutely INSIST that they follow through on, or you will take it their higher ups.
4. Yes, deifinitely stay calm.

My feelings exactly. The main thing is to stay calm. Sometimes this can be difficult when you are trying to deal with a person/company that is either slow in responding or doesn't appear to care.

Your item by item check list is the only way to go. my only addition to this would be to send copies to your local consumer advocates.... weather private or government.

Don't know if this is relevant to you but...........

I have just put the one of the bale of hay into photoshop and although very pixelated because of the file size, it still brightened up when I adjusted the curves and then everything was visible..........

1/1663 at F8!! I checked the header info and it's right. That just isn't possible at 11EV. That shutter is way too fast.

OK, so the camera is broken and it's very easy to prove. They will have to fix it for you. No question. So the only problem this time is to get them to do it quickly or give you a new camera.
You're going to get a result. They must fix this.

Just to refresh - at present only COPY IN Fuji. Whilst they did the repair, don't forget we are using the argument that the retailer arranged for you to send the camera direct to Fuji though, under UK law, it was THEIR (the retailer's) responsibility to exchange or immediately fix the camera.

Whatever you do, DO NOT contact Fuji and ask/expect them to do ANYTHING at this stage as the idea is to keep the responsibility with the retailer, where it should have been from the start.

Just terribly underexposed. From the looks of the EXIF numbers it almost like its computing exposure for ISO 1600 or 3200. Have you tried IS0 200 setting?.. just to see what happens?

But on the only free afternoon in this holiday time. Those rare moments of free time are spoiled by ....FUJI.
