if anyone can IDENTIFY the subject, please send me her phone number. I would like to have her pose for me...

It was taken on a public beach, but I see no invasion of privacy
The Beach is a "PUBLIC PLACE"

Yes, Frances, the beach is indeed a public place, and I'm no attorney, but I believe that if the subject of a photo is a recognizable person, you must have that person's permission to use that image unless it's used in a journalistic setting. One gets that permission by having that person sign a model release. For instance, see my 'Skydivers...' album at http://members3.clubphoto.com/jeffrey267231/Nov_14_2000/ . I prepared MRs for every recognizable person in those pics, and when asked, they were happy to execute it. (E-mail me if you'd like a copy of the form; it's VERY simple.)

However, in this case, the person is not recognizable, so I believe you would not need an MR to publish this image.

And about that person's right to privacy, I believe she gave that up when she appeared in a public place wearing that obviously exhibitionistic bikini.

PLS DO NOT take my casual comments above as GOOD info on this subject. I'm sure you can get more-reliable info searching the 'net.
I'm not talking about partial nudity kind of stuff. I'm talking
about Privacy. I'm not sure if you can legally get away with.
Morality is a different subject.

Frances,

First I would like to tell you that I admire your work. Anybody complaining about this picture needs not to look at it.
1. Maybe the people that complain are jeolous that they come home to
someone who needs 5 of those suits to cover half their B-tt.
2. Secondly, I agree, you wear a suit like that, you pay the consequences.
3. Maybe the people complaining have something up their ---!!

ps Keep up the good work. When it warms up out east, I will have some to throw your way!

Not at all my main subject at the beach is always windsurfers, kitesurfers and surfers because I like shooting action water sports, but if a "BIMBO" cross my line of fire is a BINGO for sure, you bet.

:)))

Please go to Malibu!

Frances.
I know I can alway count on you for some eye-candy! I bet you have
one of those special "sex-seeking" meters installed on your camera
. . .

Always a crowd pleaser. Can't wait 'til summer, I'll post some
California "beach" photos for you.

Is risking your camera and get as close as you can.

Frances.
