Was at Wallmart today, had my camera with me. There was a terrable collision in the front of the store. A truck slammed into the back of a Cadalac, pushing into the car in front of him, pushing that car into another, and the next car into another.( 4 cars and a truck). The person in the first car was killed. I had my camera and took a couple pictures.The police asked if I was with the media, I replied no, and he said not to take any more pictures because this was now a crime sceen, and that the homicide department was investigating the accident. I put my camera away, folded my hands, bowed my head, and said a prayer.

Well, actually I did not know the seriousness of the accident untill I got there, I saw a bunch of police cars and fire trucks, so I went to see what was going on. The people had been removed already, I saw no blood or anything, I would never have photographed that. When I arrived at the sceen, and only saw twisted metal, is when I decided was ok to take a few shots.

I enjoyed (perhaps no the right word) the pics. I have actually done this a few times myself. Maybe I'm perverse, but I find this kind of real life stuff interesting.

Train to fight, fight to win
 
but these truck drivers are getting bad! Every morning, here in chicago, you hear of an overturned truck blocking the expressway. This morning a garbage truck knocked down SEVEN utility poles in a nearby suburb. SEVEN! I work outside near streets and I estimate about 90 percent of truck drivers are on a cell phone while driving. How fast was the truck driver at the walmart catastrophe driving, in a parking lot mind you, to move four cars!
Sorry for my rant but traffic is getting out of hand here.

I belive the correct answer might have been that yes you could be with the media. I see shots all of the time in the paper that are not taken by staff photogs. As hurricane Isabel heads for the coast our localpaper.com is asking for storm damage pics. However, if it makes you uncomfortable to take this kind of shot then don't.

I'm curious to know why it is okay for the media to take pictures but not the public. Is this an enforceable statute or just an abritary decision of the some law enforcement official?

I don't like taking those kind of pictures. But if you wanted, you should of said that you are a freelance photographer, and he would of been unable to stop you from taking pictures. They can only control how close you can go to the scene. To be honest, I don't think he could of stopped you anyways if you weren't interferring in a crime scene.

Life is just a stage and we all have enough pictures to proof it!
 
It did not happen in the Walmart parking lot, it happened on a high speed road in front of Wallmart. There was a traffic light to enter into walmart. It looked to me like the truck was traveling about 50 miles per hour, and never even saw the cars stopped at the light. I dont know why, but that is how it looked to me. To do the kind of damage that I saw I promise you he was moving fast. I dont know any details of how or why.

I drive the freeways here in Southern California all the Time.

I see so many people cut in front of big trucks. We have Semi's here all the time since this is the best and fastest way to travel.

The thing is that many of these trucks are loaded to the gills with Stuff! Because of that they cannot slam on their brakes and stop on a dime like these fast little cars cutting in front of them.

Also a lot of the big rental trucks have bad brakes due to lack of maintenance.

If they have to slam on their brakes and someone has just cut in front of them, they may end up just like this picture! That car in front is a large car. It looks like a Lincoln Continental. I can only imagine how heavy that truck was to do the serious damage that it did!

Drive Offensively. Anticipate. Don't think the guy coming to the red light will stop. He may not. Don't think the people behind you see your brakes lights. They may not. If you have to come to a sudden stop, use your emergency flashers to get the guy's attention behind you.

I have seen too many pileups to trust that drivers are aware when they are driving.

Most of them are "checked out" - either on a cell phone, thinking about something other than what they are doing or just drunk or on drugs. It's pretty sad.

Actually, you are correct, and you are wrong. If the police ask me if I am from the media, it does not matter what my answer is, I legally can keep shooting. But when it is a crime sceen( Homicide was there) it becomes a little different. Most media will respect the law and move back at a distance if asked. They to do not want to interfere, or create a confrontation. Is best to be respectful of the law, especially if you want to be there for the next incident.9 If you are media)

Actually, after he said that I could not take any pictures, I said to him"This is a public Place" He got very angry, and said in a firm voice that this was a crime sceen. Legally speaking, I dont think he could do much if I refused to shoot. But there was a death her, and in respect of that lifre I certainly was not going to creat a sceen. I bowed my head , prayed, and left.

I don't see anything wrong in your taking the picture. (I appreciate your not posting pictures of the blood & gore, though!)

I agree with DeeDee G in that the picture can serve a very useful purpose--to remind us all to drive a little more carefully--and keep an eye on the other guy.

Maybe we should also get behind our law enforcement agencies and ask them to ENFORCE the law. A much better job could be done of enforcing the law regarding excessive speed and maintenance of these huge trucks, and driving while under the influence, etc.

It is hard to believe that it is against the law to take the picture, as long as you do not interfere in any way with the investigation. But, I recall an old saying: "You can beat the rap but you can't beat the ride." It wouldn't have been worth it if the policeman had become so annoyed that he arrested you. Would have been a major hastle!
