advice needed on what to do with amazing shot

If you didn't give them permission, how did they get access to it? I'm just curious, because it was posted on this thread only briefly. Did you post it elsewhere? Did you post it somewhere, where copyright was granted (wikipedia commons would be an example)?

I emailed a few small jpegs to some friends. I guess a few got forwarded around and now it is out there. I have never sent the original full def pics out, I still have them.
 
if you were so worried about them getting into the wrong hands -- which it appears they have -- why didn't you watermark them?

I dont get it... usually if you got something "Exclusive" you'd find ways to keep it so.

BTW, I have an alien fetus that dropped into my backyard, can someone come over here and tell me what to do with it?

Firstly of course you can go after them. They should at least tell you where / how they got the photo, and it may be neccesary that you then have to go after that scource.

Hopefully though, they'll just admit a mistake and pay you retrospectively. I've had that happen before

Out of interest though, how did you find out about them publsihing them?

Finally I don't know if I should eat humble pie a bit, perhaps not, because I did say Ilike to see them cropped and printed larger, but now they are far more interesting and eye grabbing photos.

That crop made all the difference, from boring to dramatic.

But someone must have been able to see them full res to deciede to use them and of course get them full res somehow any way to use them.
 
I never sent out the full res pictures so they have just used what was sent to them.

It is an interesting story how I discovered my pictures on their website...

My husband received an email from someone showing him some amazing pictures. When he opened the file he was shocked to see my photos. That made me wonder who else had them so I googled "Eagle attacks swan picture" and up came the Sun's site with them on it today!

I have emailed the Sun to tell them they did not have my permission to publish the photos, that the info is oncorrect and they did not give me photo credits...

I will wait and see what their answer is!

Having read several of your posts in this thread, I have come to this conclusion:

The answers you are getting (after stripping away the judgemental barbs from others) are not the answers you want to hear.

So, if you are expecting to be cottled, you are in the wrong place.

Go ahead and hate me for saying it, but it is definately what I see happening here.

I hope they pay you. It costs them almost nothing to apologise, give you the credit, and pay a reasonable fee. The cost of fighting it would be much more.

I think you should send them a bill for the amount you think you are entitled to. Meanwhile, if the image isn't already registered, do that. I believe international copyright law applies here. You are protected. It's just a matter of how to defend your right. Hopefully, you will simply get a payment for your bill, if you think that is equitable.

Agreed. Regardless of how they got the photos, YOU are still the photographer, and you retain the copyright.

Did you at least have your copyright info embedded in the image? You should start doing that with every image you shoot, if you don't already. But that still doesn't change the fact that you are the copyright holder and that they published the images without your permission or compensation.
Have they responded to your e mails?

Like the previous poster said. Invoice them and see what response you get. Good Luck.

not sure why they would settle for lo-res pictures, especially when they weren't supplied by the rightfull owner..I guess that is how the tabloids work.

I have emailed them...I would like to be given due credit ( and of course any $$ )

I will let everyone know what the outcome is.

I still haven't even bothered making a print for myself yet, my hubby wants me to make a collage but I think 2 separate prints of the best shots will be better than one collage....

Hi Kelly, wonderful photos....I was forwarded 5 or 6 of your photos re the eagle attacking the swan. The person who sent them to me had no idea who had taken them (great photos travel quickly!!!) I forwarded them on to members of the Harbour City Photography Club and a few others and have since been trying to find the name of the photographer so I can follow up with that info.

I will be following up with the photo credit (your name) and am wondering if you would like any contact info included along with your name.

I have been contacted by the Sun tabloid and they have offered compensation for more than $1000.00USD for my photos! I am pleased with this amount...

Has anyone had any experience with the Sun ( UK ) and other amounts paid for nature photography?

I've learned that in spite of having a bold request at the bottom of every one of my emails (regardless of recipient), photo emails get forwarded around far and wide. I've gone to not sending photos in emails except to clients that ask to see specific images for future projects.

If you email photos, to anyone, you can expect this type of thing to happen. Whether you like it or not. You are lucky the Sun agreed to pay you, many places that have stolen my images won't even agree to take them off of commercial websites and when they are in a different country, there is precious little I can realistically do about it....and they know it/

I asked a friend of mine in the UK to find me a few copies of the magazine to send to me...She is having fun going around to all her friends showing off my picture to them in the magazine!

The Sun has offered to help me get the photo syndicated as well...not sure what is involved with that???

I emailed the photos to 8 family members the day I shot them, I guess they were forwarded from that point on.....

....but at least it is netting me some cash!

It looks like this ordeal is having a happy ending.

Hmmm. I wonder how long it will be before someone sends you a cool picture via email that they received from someone that happens to be your picture.
