Realtor using my pictures..what to do?

My house was listed with a realtor and I supplied the images for use online. My listing expired with that realtor. A realtor from a different company sent me a copy of a listing flyer showing my picture of my house on it, telling me that this is how my house would be advertised with his firm.

I'm not wanting to make a big deal out of this but I'm also a freelancer and have not given him verbal or written permission to use my images in his advertising.

Should I ....

1. just send him a cease-desist letter
2. threaten him with copyright infringement action
3. none of the above

This is by far the funniest post for the month of March Congratulations for getting it in just under the wire for the March entry deadline.

You want to stop YOUR realtor from using your photo of your house? You'd rather he come out and shoot it with a P&S?

Do you want your house sold or not?
They are not going to pay you for your picture to run a better ad with.
Most you can do is get them to stop selling your house.

Did you even read his post?

If using for general brochure - sure have him stop using it. But it just sounds like he was soliciting you for you to sign with his realty office and showing you how he would market your house. If there is nothing particularly "photogenic" about your house I doubt if would be in his general marketing materials. You should definitely ask...

The realtor is acting as your agent to sell your house.

I guess that means you will have to sue yourself.

Good luck finding a lawyer.

A realtor sent you a sample brochure showing how your house would be listed with their firm--a mock ad. I don't understand what the big deal is?

Or are you saying that they used your house on EVERY brochure they sent to EVERY customer because they were too cheap to buy a $10 stock photo like this one:

It was his house.
The ad was to sell his house.

Indeed it was a sample of his marketing approach he would use after the other listing expired.

There is ZERO legal action taht can be taken for this usage.

every Realtor in town published an distributed a brochure showing photos of your house for sale.

If the home has good curb appeal and the your photos show a nice home it just might help sell your home.
