On my new D70, black spots show up during play back on LCD

Are they on the pictures when looked at on the pc?

if not then you have dead pixels on the Lcd Screen, and thats Defective.
screen, but haven't noticed any on cards once on computer and/or

Well it always sucks when you get something that does not work right..

Unless you want to wait weeks for Nikon to start working on it or send it back, You will have to decide if it's so bad you can't deal with it.. Or if it's not that bad you can deal with it.

Also if you shoot pro and need the camera anytime soon, Nikon is iffy on how fast they work on cameras and send them back.

Yah, "Dead Pixels" or "Burnt Pixels" are common to LCD's of any size. Personally, I'd return it, since it is defective, the store won't package it up and just return it to the buyer they got it from as defective, just make sure you tell them it's burnt pixels.

If it is out of warranty, and that doesn't bother you, hang on to it based on how much you NEEEEEEED it. I use mine every day, so being without it would make me go through withdrawal.
