There is a legal distinction between commercial and editorial photography.

If you are doing photography specifically for advertising and marketing purposes—which is commercial photography—then presumably all of the clearly identifiable people and proximate places in the photo are implicitly endorsing the product being marketed. Falsely implying that someone or some property owner endorses a product when they do not can lead to legal liability. So for commercial photography you need model and property releases to avoid legal trouble.

Editorial photography is basically every other kind of photography.
