Or rather clarifies. Seems that, yes, while the terms of service do allow Instagram the right to sub-license that does not mean that they actually grant such a sub-license.

They have stated publicly that no such sub-license is granted and that anyone embedding someone else's copyrighted content will need a license from said owner...
