EOS R not focussing correctly

Hi - I am finding that in some situations the focussing is really not doing the right thing. I'm using (for example) 1-point-AF.  I assume that within this focus region (the square shown on the display) the EOS R is supposed to choose the exact part of the image most suitable for focussing - which in general should be the *closest* object within the chosen focus region.

However I'm regularly finding on subjects like birds that the background gets focussed instead. The image below is a clear example of this.  Even though the bird doesn't have as strong contrast/edges as the background, it does have some contrast/edges, and is clearly closer than the background. The red square is the focus region - conveniently shown because DPP allows you to display that.

Am I being stupid - doing anything wrong?
