Tripod legs get very little wear and tear with most of their owners and so buying a used one should not be a problem - especially with the ones that use flip locks to secure the legs. There are lots of used Manfrotto 190 type aluminum tripods around and most sold new for around $150 or less.

I have not had any success in finding a cheap ball head that works well. The best inexpensive ones I have found are the Oben and the Oben tripods are also excellent and a good value.
