I do not own the 17-40, but this subject has come up elsewhere. The new 16-35 f/4L IS is superior, but I don't have any hands on info comparing it to the f/2.8 versions.

To the second question, I'm astonished that the relatively affordable 16-35 f/4L IS appears just as good as the 24-70 f/2.8L II, which costs twice as much! I keep expecting there to be some difference in the 24-35 range, but I honestly cannot tell the difference between the output of the two lenses in real world photography.
