I am pretty peeved over this - I know the X-A1 isn't exactly an expensive camera, but I can't understand why I keep getting sent back cameras with the same (albeit in different places on the frame) issue. I've never seen anything like this on other interchangeable lens cameras I have owned.

Anyway, I'm not 100% sure those are dust spots because they look a little too well defined for dust. There is a spot, at the top right, which isn't circled that looks like dust.

I'm a little surprised by your post because this is the first I've read about a problem like this. I don't own an X-A1 (have an X-E1) but I think I'd call Fuji service and talk to them along with emailing them a picture showing the problem (you may have already done this).

Seems like Fuji would either fix the sensor or would explain why they can't repair the camera.

I've owned several digital cameras, over the years, and been lucky because I've only had one serious problem with any camera and it was repaired without a hassle (that was on an older Sony camera).
