I'm really hoping someone can answer this copyright question. I am in the USA so USA law applies. I did photography of an art exhibit for one of the artists. The photos were given to the artist in an album as a gift to the artist. Someone else affiliated with the art show, used several of those photos in a newspaper advertisement. This was done so without my consent, and without a photo credit to me. Several other photos were also included in a facebook post.
So my question is simply this: does this qualify as copyright infringement?
There is a partnership agreement between the artist (whom I gave the pics to as a personal gift), and the art show host. However, there is no agreement between me and/or the art show host or the recipient of the gift. I have not been paid for the photos by anyone.
