With all due respect, and I am not an accomplished photographer, I totally disagree.  However, among other things I am certainly an extremely accomplished analyst of all sorts of graphics, especially photographs that involve as subjects birds.  I have been analyzing bird photographs for the purpose of identification for more than three decades.  I know what to look for since the expertise involved in bird identification is based almost entirely on the analysis of the detail.  I most certainly affirm that this is an example of plagiarism.  This two images are two renderings of the same photo regardless of the modification of the image as to the perch, and the angle.
