It's actually quite easy to tell if it's on the sensor (under the AA filter) or on the top of the AA filter.

A spot on the AA filter seen against an unfocused bright background (e.g. sky) will appear at high (small) apertures, and (mostly) vanish wide open as the light will some in from all around it.

A spot on the sensor itself as opposed to on top of the AA filter will always be present, as there's very little (if any) space between it and the photosite.

So shoot against an unfocused bright background at F16, and at F2.8 (or whatever is wide open), and if it's almost the same, it's on the sensor -- if at F2.8 it mostly disappears it's a normal spot on the AA filter.
