A tripod does not preclude spontaneity. But the lack of a even a small tripod at night usually precludes shooting anything at all.

If you really insist on walking around at night shooting without a tripod, you should invest in a camera with serious, serious low light performance. You'll need something like a Nikon D4 or Canon 1-DX. But they're $6,000 and nearly as big as a small tripod anyway.
