No its cropped, like 720, as if you added a letter box.

then when i go out out live view i get a full frame photo,

in the menu mode i see a LV shooting area display, with only the choice of Masked or outline

i did change the aspect ratio now to 3:2 in the Live View menu but is this how the cameras ship out of the box? 16:9 aspect ration?

I believe 3:2 is the default aspect ratio.  I've never changed it on my camera, and that is what it is set to.  You can test this by resetting to factory defaults on your camera, but I'm not about to do that myself.  Anyway, looks like you found the answer to your problem.
