Also, the photographer can go with a creative commons license. That way, you have common language terminology backed up by legal kung-fu. For instance, "use it however you want, limited to recreational use without modifications and giving proper attribution" is a creative commons no-derivs non-commercial attribution license. If you use Flickr, the option to set those terms are built into their sharing system and provide an awesome way to link the image elsewhere on the web.
