Aren't Craiglist transactions person-to-person? As such there is no sales tax. Sales tax can only be charged by a licensed business that has a sales tax collection account with the state.

Depends on the state. There are many people who make and sell homemade products, or they buy from a company to sell and make a profit.

However, one point of the legislation that has been overlooked. Companies that make less than $1M a year is not required to collect the tax. In that case, it is up to the individual states to pursue the taxes.
