With a camera as bad as you report, I would send it in before your warranty is up. Ask them to fix it and then test it for xxx number of shots to insure that the problem is actually solved. If they return it with the continuing problem, ask them to replace it.

There have been a number of reports of the Los Angeles service center actually fixing the problem.

You shouldn't have to live with a camera that dysfunctional.
