Mount if up and see if you can find any issues with the pictures from it.  You might still be able to get a filter on there if you're careful, but someone either dropped it (most likely) or got pretty rough with a filter on it already to do that damage.

I'd still recommend you complain, either ask for a partial refund, return it, or at the very least leave negative feedback. I've sold a lens a similar condition with a long explanation of similar issue in the past and I'm sure it sold for less because of it.

I got a 28-105 RS a little over a year ago for about $150 with a Maxxum 450si, 35-70 f3.5-4.5 and 70-210 f4.5-5.6 included, and everything was pretty near perfect condition.  And even if you can't see any difference in the images from it, it's resale value (should you decide to sell it) is decreased.
