James, as you are a Canadian I can understand your confusion regarding English law. The report said that the man concerned had been arrested and bailed pending further enquiries. Under English law you are arrested if it is suspected that you have committed a crime, but you then have to be charged with the offence, which is a subsequent step, to be sent for trial.

You also won't be aware of the utter sensationalism of the reporting of the downmarket newspapers, particularly the Murdoch owned Sun, in the UK. If the man had been charged or sent for trial it would have resulted in lurid banner headlines in this type of paper, and we haven't seen any. It is therefore perfectly reasonable in this case to make the assumption that the children were not the main subject of the man 's photography.
