Yes, I know that you wouldn't know it had the issue if it were new. Work with me here. My real question is which issue is considered more severe/major? (For those not admitting that an issue exists, pretend it's real)

Theoretically with all else being equal, if I have to choose a problem to have, I'll take the left focus point issue. I rarely use that point and it won't affect every scene anyway even if you do.  
In reality, i'm not going to choose between the lesser of the problems, I'll take the D800 with either problem
