gross misconceptions about how the law works

Yeah, especially with intellectual property laws. There is one fundamental rule of intellectual property laws: there are no fundamental rules of intellectual property laws.

The protection of IP is 100.00% pure legal artifice. There are no underlying principles. There are no principles that can be reasoned from. There are no principles to make IP protection reasonable or consistent, and the laws protecting IP are therefore often unreasonable and inconsistent.

The only things that can be consulted a priori are the texts of the laws and the judicial precedents. Even then, what you have is, in the words of Barbarosa, "more of a set of what you'd call 'guidelines' than actual rules." In the US, the only true determination of any particular situation is made by a Federal court, one situation at a time, a posteriori, when an infringement suit is brought.
