In the Apple vs. Samsung case, Samsung simply copied and didn't create. See the difference?

Yeah - Samsung designers surrounded themselves with Apple devices and came up with something clearly inspired by them, but maybe slightly better. No one is arguing that Samsung wasn't "inspired" by Apple - but then Apple had been similarly inspired by several other devices.

The fatal flaw of your argument is that Samsung wasn't "inspired" by Apple. Samsung's internal documents and emails clearly showed that Samsung systematically set out to copy Apple on a long, long list of design details. That was damning evidence against them.

That's why I put "inspired" in quotes. I agree they intended to copy Apple but maybe also to try and do a little better

These Samsung documents were basically the smoking gun that doomed Samsung.

They are hardly doomed - they will pay the fine, pass the costs along to their consumers, and move on. Probably they will now be even more intent on beating Apple. Look what they already did to Sony's TV business.

BTW Even if Apple now sue Google Samsung have been busily working on operating systems of there own so they are not even tied to Android
