It is against the law to use photos of kids in scenes that would lead to demoralizing them, or making them appear sexual/provocative.

Kids in bathing suits at the legal. Ask your local law department, your local legal librarian at the local state/provincial legal library.

Agreed - certainly here in the UK it's totally legal.

Although a large number of parents, teachers etc. seem to believe it's illegal or against Data Protection laws (it's not!)

However, I think the OP was referring to bans placed by schools, swimming pools and other bodies banning ALL photography
