Wrong. Payment has nothing to do with it. Unless the photographer has a signed model release then he cannot legally publish the photos.

Sorry but that's incorrect as well. Legal usage varies by locale, but in most places there are allowable uses (editorial and art are common) where a release is not needed. And in some places, notably Great Britain, a release is not needed for commercial use.
