2-bit criticisms

Regarding the controversy of the 14-bit -> 12-bit truncation in the new firmware... for those who say it doesn't matter, could someone please explain to me how one could quote (e.g. on dxomark) a dynamic range of more than 12 stops if the data is 12 bit or less?

In other words, my claim is that if the rated DR is more than 12 stops, you are by definition throwing out information if you truncate to 12 bits. Is that wrong?
