Agree, it's an unfair comparison, but marketing is always unfair. When the E-3 was released, it's direct competitor was the 40D, not the 1DIII, so it makes at least a bit more sense to compare these two. However, you can easily swap the 40D for a 400D and the marketing campaign still holds - albeit unfair and improper.

As I've said before, any manufacturer can be held in the spotlight if you normalize to their strengths. Marketing is no different.

but the E-3 is still the current top Oly model, i gather the 40D is discontinued and not been manufactured for a couple of years

neither has E3 been manufactured for a few years and further
its odds on that 40D was still in production when the E3 batch was gone and done
