Using someone else's artwork

When voting the Grey challenge I started wondering one thing. Might be I'm just a nitpicker (once again), but in my opinion, one can't make photographic art by taking a snapshot of someone else's artwork.

Those snapshots can be interesting, nicely done, and good memories. But what did the photographer do? Does he/she have the right to try to take the honor, in a challenge or anywhere?

Don't get me wrong. I'm sure it's possible to take a creative photo of someone else's artwork, give the viewer new viewpoints, by using interesting angles, macro, lights, depth of field, whatever. In these cases, I'd say it's fine to enter an unofficial photo contest with such photo. But when one simply shoots what everyone in the same museum/church/market square sees, he/she isn't creating anything new, is he/she?

Please, tell me your thoughts about this.
