If the photographer was in the United States, this person could be sued. In the USA there are lawyers willing to take any side of any case, sometimes on contingency and sometimes for a fee.

Contingency means the lawyers gets paid only is he/his client wins, so it is a gamble.

But often, the person being sued, even if not at fault in any way, will reach a settlement with the "crooked" lawyer and his client, simply to avoid having his own legal bills bill up.

It is cheaper to pay off an extortionist than it is to defend yourself in court.

The awarding of costs -- the judge makes the loser pay the winners legal bills -- is very non-predictable. More so in the USA than in many other countries.

Laws vary by country.
