Shutter Released when subject is not in focus problem on D800.

Does anyone have the issue with shutter released to take the shot when subject is not in focus on a D800?

Here's the camera configuration setting;

AF-ON button only to focus

Focus mode: AF-S and AF-C

Focus Priority selection: Focus (photos can only be taken when the in-focus indicator is displayed)

when I point the camera to the subject without press the AF-ON button to focus, obviously the subject is not IN FOCUS, the camera fired the shot on both mode, AF-S and AF-C.  This wouldn't happen on my D300.

Udated to the latest firmware, didn't pay attention to this issue on original firmware. Is this how the D800 designed? or New firmware issue? or defective Camera? Is it possible to restore old firmware back to the camera?
