They are aware. I compared two newer d800 and they are better.

As much as I tried they wont honor an out of warranty repair so if you are in warranty they will fix the QC issue. I asked if they would refund once nikon admits to it an issues an advisory to which they said they can't speak for future advisories.

I'm not a great photographer.......Yet

Recently sent my D800 to Nikon Los Angeles for evaluation of another problem. Previously required fine focus for all but one of my lenses. After return the left focus sensor auto focus problem was gone and all my lenses now require zero fine focus adjustment for optimum PDAF auto focus compared to the best obtained with live view auto focus (CDAF) and manual focus.
