Live view AF and remote release D7000

I am puzzled by the way AF works in Live view with my D7000 using the ML-L3 remote.  
I want to set the camera on a tripod, frame the subject and use the back button (Assign AE_L/AF-L button to AF-ON) to set the focus.  I then want to release the shutter using the remote without the AF re-focusing.  Set to single point AF-S this works as intended.  
Sometimes I can't easily get my eye to the viewfinder and therefore use Live view.  I have the Live view AF mode set to AF-S.  I focus with the back button.   When I attempt to expose, the camera does not refocus if I use the shutter button but irritatingly does refocus if I use the remote.  This is not what I want.  I could flick the focus switch to manual but it is a bit of a fiddle and I would prefer not to have to do that every time.
Is there a setting I am missing or is this how it is supposed to work?
