The F2.8 choice, 12-40mm vs 12-35mm

Is the 12-40mm really a non-extending lens?

Just from this photo, the end looks like it'll extend when you zoom. How else do you explain the "gap" just below where the hood attaches? The patent also indicates a length of 131.16mm – 140.24.
