DPR violating image licenses

I've commented on the story itself:

But apparently there is no response to be had from the editors. I would ask them to please explain under what rationale they are using a Creative Commons Non-Commercial licensed image on a commercial site at a resolution that others would interpret as being too large to qualify as fair use:

Please explain, or amend the article to something in line with widely held interpretations of fair use.
