What photons that penetrate the Bayer CFA filter is a statistical process. How deep a photon travels in a Foveon sensor before being absorbed is also a statistical process. So, at least at low exposure, there is a significant fluctuation. Moreover, how many photons hitting the camera of different wavelengths is a statistical process. So - even if the filters exactly removed e.g. 43% of all green photons (which it does not) you would have a fluctuation in color exposure.

And all this ends up as colored photon noise.
