This is a crazy argument. There is virtually no part of the earth that is not publicly or privately owned by some entity. By this argument all photography of anything except the sky would be public property. What about a painting of public property? There are millions of dollars worth of famous paintings of publicly owned properties in collections and museums all over the world. What of them? Is painting an art form created and owned by the artist except when done for hire? Is photography any different? Why?
