I am not so sure about that. Once upon a time, when the "pirate" lenses arrived on the market, there was big discussions regarding if it was legal or not to make lenses with "pirate" mounts. But, it was decided that it was OK.

And there was earlier lots of cheap cameras that used m42 and K-mount, and I would be surprised if they did any licensing. No one has dared touching Nikon and Canon mounts though, as far as I know. Fuji did use Nikon mount, but I think it simply was a licensed and modified Nikon camera.
