ETTR is about putting your highlights right against the right edge of the histo, but NOT beyond it.    If you are beyond, you did it wrong.   The alternative is not worrying if your highlights come a bit short of saturation, and hoping the camera sensor has enough range to resolve the shadow details you care about without much noise.
