Focus priority is useless

Can someone explain to me why when setting the d800 to focus and not release priority, it still lets you focus when the lens hasn't managed to focus on the subject. Why? Why have this setting it's it ignores it anyway and does what it wants? The d700 and d3s managed this!I have noticed that in a f s mode it can take a second or half a second to focus sometimes and I see the rangefinder move before the dot lights. Pressing the shutter during this time gIves miss focus. This setting would help if it worked! I don't want the cam to take a shot if the system is actively adjusting focus. Why won't it let me set this!
