Looks used. If it was described as new then it was a misrepresentation and you can return it. You can always try to return any item you find questionable, even if the seller refuses. Some sellers think if they write "sold as is" it would absorb them from any responsibility, while in reality that phrase has zero value. If the item is not as described a buyer has the right to return it for a full refund. The Buyer Protection usually works very well as long as you make reasonable claims.
