If I understand your question correctly, the answer is that 9,21,39 and 3D focus points are only available in AF-C and AF-A modes as they are intended for tracking moving subjects.

In AF-S mode, only a single AF point is used but it can be moved to any of the available 39 points with the D Pad.

A compromise is AF-A mode that offers a user selectable single focus point and switches to user selectable 9,21,39 and 3D tracking modes when subject movement is detected.
