I think he is allowed to expose his pictures the way he want.

Of course he is allowed to expose his images any way he want but if the exposure causing problems then the exposure is wrong. Other than that, he was asking about how to get the background black, and the answer is still "by exposing right and using black background", NOT by underexposing the whole image.

Those lines on the water in the second image looks like being caused by the long exposure, reflections of the cloud movements and the waves on the water. There is no way I would worry about that, other than the exposure is wrong in that image also as well as the focus is also missed.
