No, I am not saying they have the right to decide, I am just saying that they do. And yes, citizens do decide which laws they will obey, right or not right. Cars breaking the speed limit is an example. As are those who make moonshine. There are numerous examples.

I am not saying the sheriff or the citizen has some kind of basic right to decide laws they will recognize but I am saying the decision is often made.

If local sheriffs won't enforce federal law, federal agents can do the job if the violation is serious enough. In your example of moonshiners, the federal revenuers (tax agents) were the main enforcers in many cases.

Local sherifs have no jurisdiction with Federal laws so it isn't up to them to enforce it. This is all a political posturing by the right-wing nuts who are building themselves a platform for re-election.

Does that make it possible that local sheriffs would leave bootleggers and moon shiners alone, letting the federal agents play their own game ?

There are also local laws. In the classic case of moonshine (Georgia White Lighting) in the South, the moonshiners thrived because of local Blue Laws (liquor cannot be sold on Sunday). People wanted to buy liquor on Sunday after they cashed their paycheck. So local sheriffs and police raided moonshiners on Sunday.

The federal revenue agents raided the moonshine stills in the woods.
