Yes, this is the lawyer's bread-and-butter dreamland.
Suppose there is a printed reproduction of Mona Lisa. Some photographer takes a photo of that copy and it is published in the high-quality inflight magazine. I take a photo of the magazine image and post it up with my watermark. It is my photo, so why not?
What is actually being copyrighted? A fourth generation copy of an ancient original, right?
And yet, there is that "certain smile" above my watermark that people instantly recognize, since no-one sees the source of my image...
Whatever the logic, there is always this legal wordplay which renders it bewilderingly complicated.
