The words of the Founders in the Federalist Papers are quite clear. The Senate is supposed to approve or reject Presidential appointments ASAP. The technical trick of "staying in session" when they are not in session violates the Constitution.
I think this is the real issue that will be argued when this get to the Supreme Court. This has been a long time coming and affects both parties as the majority in the Senate changes over time.
The Senate, when it uses it's advice and consent power as a means of destroying the Executive Branch is stepping on the very Constitution itself. Rejecting or apporving an appointment is Constitutional, refusing to do either is not.

The Constitution doesn't agree with you. No executive appointments while the Senate is in session which it was. The language is perfectly clear. Obama acted illegally and the court said so.
The House is required to pass a budget, which the Senate can then approve, modify or reject.
But the budgets HAVE been sent from the House to the Senate and the Senate does nothing. That's not allowed.
It should be an interesting court session to listen to. KPFK radio generally covers these sort of cases in real time BTW.
